TERMS OF SERVICE & REFUND POLICY

1. Services & Products Covered

Modern Soundworks provides:

• Commercial Software: Native applications and digital tools including TrackVision and DDP Studio.
• Audio Mastering Services: High-resolution mastering tailored for streaming, vinyl, and compact disc.
• DDP File Creation & QC: Production-ready Red Book CD filesets and streaming MD5 checksum verification manifests.
• Technical Consulting: Custom studio automation, audio pipelines, and DSP engineering.

2. Pricing & Payment Processing

All transactions are conducted in United States Dollars (USD) unless explicitly stated otherwise. Audio mastering projects are priced transparently at a base session setup fee of $100.00 plus $5.00 per minute of audio (with optional add-ons including DDP manufacturing filesets and vinyl pre-masters). Software licenses and consulting services are billed at posted rates or mutually approved milestone scopes. Payments are processed securely via our payment partner, Stripe, Inc. We accept major credit and debit cards (Visa, Mastercard, American Express, Discover) as well as modern digital wallets where enabled. We do not store sensitive payment card details on our servers.

3. Delivery & Fulfillment Policy

• Digital Software Licenses: Delivered electronically immediately upon transaction confirmation via digital download link or license key sent to the purchaser's email address.
• Audio Mastering Deliverables: Master audio files (WAV 24-bit / 16-bit) and verification reports are delivered via secure digital download links within 3 to 5 business days of session deposit and audio asset receipt (rush options available upon mutual agreement).
• DDP Filesets: Delivered electronically via secure download within 24 to 48 hours of project confirmation.

5. Intellectual Property Rights

• Client Content: You retain 100% sole ownership, copyright, and publishing rights to all musical compositions, sound recordings, artwork, and metadata you provide to Modern Soundworks for mastering, DDP authoring, or video processing.
• Software & Proprietary Algorithms: All rights, title, and interest in and to TrackVision, DDP Studio, and any proprietary software code, icons, or documentation remain the exclusive property of Modern Soundworks.

6. Limitation of Liability

Modern Soundworks shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our software or delays caused by third-party replication manufacturing plants. In all circumstances, our maximum liability is limited to the exact amount paid for the specific service or license in dispute.
